Overview
This website and online store are operated by Nexus PC Works, LLC (“Nexus,” “we,” “us,” or “our”). Throughout these Terms of Service, “Services” refers to our website, online store, products, services, content, features, and tools.
By visiting our website, purchasing products, requesting services, or otherwise using the Services, you agree to these Terms of Service and the policies referenced within them, including our Refund Policy and Privacy Policy.
If you do not agree to these Terms, please do not use the Services.
Nothing in these Terms limits any consumer right or remedy that cannot legally be waived under applicable law.
1. Eligibility and Accounts
You must be legally capable of entering into a binding agreement to make purchases through our store. If you permit a minor to use the Services, you are responsible for their use to the extent permitted by applicable law.
You agree to provide accurate, current, and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
We may refuse service, restrict access, or cancel accounts where reasonably necessary to address fraud, abuse, unlawful activity, security concerns, or violations of these Terms.
2. Products and Availability
Nexus sells products that may include trading card singles, sealed trading card products, collectibles, computer components, gaming products, peripherals, and other merchandise.
Inventory is subject to availability and may change without notice.
Some products, particularly trading cards and collectibles, may be available in limited quantities. Placement of an order does not guarantee availability until the order has been accepted and processed.
We reserve the right to limit quantities when reasonably necessary, including to address inventory errors, suspected fraud, abuse, or circumstances affecting product availability.
3. Trading Cards and Collectibles
Trading cards and collectibles may vary in condition and appearance.
We make reasonable efforts to accurately describe individual trading-card singles and other condition-sensitive collectibles. Customers should review available descriptions and photographs before purchasing.
Minor differences in color, appearance, centering, printing, surface characteristics, or other manufacturing variations may occur.
For sealed trading card products, Nexus does not manufacture or control the contents of individual packs, boxes, cases, or other sealed products.
We therefore do not guarantee particular cards, rarities, pull rates, monetary value, grading results, print quality, centering, or other contents of a factory-sealed trading card product.
Opening a sealed trading card product may affect its eligibility for return as described in our Refund Policy.
4. Orders and Acceptance
Submitting an order constitutes an offer to purchase the products or services listed in the order.
Receipt of an automated order confirmation does not necessarily constitute final acceptance of an order.
We may decline or cancel an order when reasonably necessary, including because of:
- Product or inventory errors
- Pricing or listing errors
- Payment authorization problems
- Suspected fraud or unauthorized transactions
- Shipping restrictions
- Product availability
- Technical errors
- Quantity limitations
If we cancel an order after payment has been collected, we will issue an appropriate refund.
Customers are responsible for reviewing their order, shipping information, and product selections before completing checkout.
5. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Prices, promotions, discounts, and product availability may change without notice.
We attempt to provide accurate pricing and product information. However, typographical, technical, inventory, or pricing errors may occasionally occur.
If a material pricing or listing error affects an order, we may contact you to offer the opportunity to proceed at the correct price or cancel the affected item or order and issue an appropriate refund.
Applicable taxes and shipping charges will be displayed during checkout when required.
You represent that you are authorized to use the payment method submitted with your order.
6. U.S. Sales and Shipping
Our online store is currently configured for sales and shipping within the United States.
Available shipping methods, charges, and estimated delivery information are presented during checkout when applicable.
We will make reasonable efforts to fulfill orders within the timeframe stated to the customer and will handle delays in accordance with applicable law.
Delivery estimates provided by carriers are estimates and may be affected by weather, carrier disruptions, holidays, emergencies, incorrect customer information, or circumstances outside our reasonable control.

7. Local Pickup
Local pickup may be available for qualifying orders in the Cincinnati, Ohio / Northern Kentucky area.
An order is not ready for pickup until you receive confirmation from Nexus.
Customers should follow the pickup instructions provided with their order. Identification or order verification may be requested before merchandise is released.
8. Returns, Refunds and Cancellations
Returns, refunds, exchanges, and cancellations are governed by our Refund Policy, which forms part of these Terms.
Different return conditions may apply to trading-card singles, sealed trading card products, electronics, custom products, custom PCs, special orders, and 3D-printed products.
Please review the Refund Policy before making a purchase.
9. Custom Gaming PCs and Computer Products
Custom gaming PCs and other made-to-order computer systems may be assembled according to specifications selected or approved by the customer.
Component availability and pricing can change rapidly. If a selected component becomes unavailable before procurement or assembly, we may contact you regarding an appropriate substitution, modification, or other resolution.
We will not make a material substitution to a custom build without customer approval where that substitution materially changes the agreed configuration.
Customers are responsible for providing accurate information about their intended use, compatibility requirements, and other requested specifications.
Manufacturer warranties may apply to individual components. Such warranties are provided by their respective manufacturers and are separate from any warranty or service commitment expressly provided by Nexus.
Nothing in this section limits rights provided by applicable law.
10. PC Repair, Upgrades and Technical Services
Computer repair, diagnostic, upgrade, installation, and related technical services may require access to customer-owned equipment.
Customers are responsible for maintaining appropriate backups of important data before submitting equipment for service whenever reasonably possible.
Although we take reasonable care when servicing customer equipment, computer repair and diagnostic procedures can reveal or involve pre-existing hardware failures, corrupted software, failing storage devices, malware, or other conditions outside our control.
We do not guarantee that lost or corrupted data can be recovered.
Any additional work or material expense beyond the agreed scope will require customer authorization where appropriate.
Specific service terms, estimates, work orders, or written agreements provided for a particular repair or project may supplement these Terms.
Nothing in this section excludes liability that cannot legally be excluded.
11. 3D Printing Services
Nexus may provide contract 3D printing services using digital files or specifications supplied or selected by customers.
Customers are responsible for ensuring that they have the legal right to provide and reproduce any model, design, file, logo, character, artwork, trademark, or other material submitted to us.
By submitting a file or design for production, you represent that you own the necessary rights or have permission to reproduce the material for the requested purpose.
You retain ownership of rights you hold in customer-supplied files. Providing a file to Nexus grants us only the rights reasonably necessary to evaluate, prepare, manufacture, and fulfill your requested order.
We may refuse a printing request when we reasonably believe the requested item would violate applicable law, intellectual-property rights, or our policies.
3D printing involves manufacturing tolerances and process variations. Minor differences in surface texture, layer lines, support marks, dimensions, color, or finish may occur and do not necessarily constitute a defect.
12. Intellectual Property
Unless otherwise stated, the original content, branding, graphics, text, website design, photographs, logos, and other materials created by or for Nexus and displayed through the Services are owned by Nexus PC Works, LLC or used under appropriate license.
You may not reproduce, distribute, sell, modify, or commercially exploit our proprietary content without permission except as permitted by law.
Names, logos, artwork, characters, card games, products, and other intellectual property belonging to third parties remain the property of their respective owners.
The sale of third-party products by Nexus does not imply ownership of or affiliation with those intellectual-property owners unless expressly stated.
13. Customer Reviews and Submitted Content
If you submit a product review, comment, photograph, testimonial, suggestion, or similar content to us, you represent that you have the right to provide that material.
You grant Nexus a non-exclusive, worldwide, royalty-free license to display, reproduce, and use that submitted content in connection with operating and promoting our business and Services, subject to applicable law.
We may remove submitted content that is fraudulent, unlawful, abusive, misleading, infringing, spam, or otherwise violates these Terms.
We will not condition publication of legitimate reviews solely on whether they are positive or negative.
14. Third-Party Services
Our store may use third-party services and applications for functions including payments, shipping, product reviews, analytics, customer communication, quoting, and other ecommerce features.
Use of some third-party services may also be subject to the terms and privacy practices of those providers.
Links to third-party websites are provided for convenience and do not necessarily constitute endorsement.
15. Shopify
Our ecommerce store is powered by Shopify.
Purchases made from Nexus are transactions between the customer and Nexus PC Works, LLC. Shopify provides technology supporting the store but is not the seller of Nexus merchandise or services.
Certain information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy documentation.
16. Prohibited Uses
You may not use our website or Services:
- For unlawful or fraudulent purposes
- To violate another person's intellectual-property or privacy rights
- To transmit malware or malicious code
- To interfere with the security or operation of the Services
- To attempt unauthorized access to systems or accounts
- To submit false or misleading information
- To engage in fraudulent purchases, chargeback abuse, return fraud, or payment fraud
- To impersonate another person or organization
- To scrape, overload, disrupt, or misuse the Services in a manner that materially interferes with their operation, except where such activity is protected by applicable law
We may restrict access or cancel transactions associated with prohibited activity.
17. Errors and Corrections
Information on our website may occasionally contain typographical errors, inaccuracies, outdated information, or omissions relating to product descriptions, availability, prices, promotions, shipping charges, or other information.
We may correct these errors and update information when discovered.
If an error materially affects an order that has already been placed, we will take reasonable steps to notify the affected customer and provide an appropriate resolution.
18. Disclaimer of Warranties
We make reasonable efforts to provide accurate information and reliable products and services.
Except for warranties expressly provided by Nexus or rights and warranties that cannot be excluded under applicable law, the website and Services are provided on an “as available” basis.
Third-party products may be subject to warranties provided by their respective manufacturers.
Nothing in these Terms disclaims or limits warranties or consumer protections that cannot legally be waived.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Nexus PC Works, LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, products, or Services when such damages may lawfully be excluded.
This limitation does not apply where liability cannot legally be limited or excluded.
Nothing in these Terms is intended to limit liability for conduct or damages for which limitation is prohibited by applicable law.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold Nexus PC Works, LLC harmless from third-party claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.
For customer-supplied 3D-printing files or other customer-provided materials, this includes third-party intellectual-property claims resulting from material you submitted without the necessary rights or authorization.
21. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
Please review that policy for information about the categories of information collected, how information is used and disclosed, cookies and similar technologies, and privacy rights that may apply to you.
22. Governing Law
These Terms and transactions with Nexus PC Works, LLC are governed by applicable United States federal law and the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where the laws of another jurisdiction provide consumer rights that cannot lawfully be waived.
Nothing in these Terms prevents a customer from exercising rights or remedies available under applicable consumer-protection law.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.
The remaining provisions will continue in effect.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, Services, policies, or legal requirements.
The current version will be posted on our website with an updated revision date.
Changes will apply prospectively unless otherwise permitted or required by law.
